Intersection Violations
(
Traffic Code 544.007 to 544.010):

The Traffic Safety Focus for the month of August 2007 is any type of intersection violations. The guidelines for the requirements to avoid any type of intersection violation can be found in the Texas Transportation Code Sections 544.007 Traffic Control Signals in General, 544.008 Flashing Signals, 544.009 Lane Direction Control Signals, and 544.010 Stop Signs and Yield Signs.

§ 544.007. TRAFFICE CONTROL SIGNALS IN GENERAL.

Any time a traffic signal is red, the driver of a vehicle must stop and may proceed only when the intersection may be entered safely and lawfully, after yielding the right of way to pedestrians and other traffic lawfully in the intersection.

§ 544.008. FLASHING SIGNALS. 

If a lane-direction-control signal is placed over an individual lane of a highway, a driver may drive in a lane of traffic over which a green signal is shown but may not enter or travel in a lane over which a red signal is shown.  The El Paso Police Department would like to remind the community to continue to drive safely and courteously in an effort to prevent and reduce traffic related injuries and fatalities.

§ 544.009. LANE DIRECTION CONTROL SIGNALS.

Anyone approaching a flashing red signal must stop and proceed only when it is safe to do so.  Any driver approaching a flashing yellow signal may proceed through an intersection or past the signal only when it may be done safely (This does not apply to railroad crossings).

§ 544.010. STOP SIGNS AND YIELD SIGNS.

Whenever a stop line marking on the pavement is present, the driver of a vehicle must stop at the stop line.  If a stop line is not present, the driver must stop at the stop signal, sign or the place nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway.  Any driver approaching a yield sign must yield the right of way to traffic and pedestrians and if necessary may stop until the roadway may be entered safely.
